UA-Residency is not a government body and is not affiliated with, endorsed by, or acting on behalf of the Government of Ukraine or any of its agencies. We are a private law practice. We cannot issue, grant, or guarantee any visa, residence permit, passport, citizenship, or other official document. Those decisions are made solely by the competent Ukrainian state authorities. Government forms and applications can be obtained directly from the relevant Ukrainian authorities, in many cases free of charge or for the official state fee only. Our fees are payable for professional legal services and are separate from any official state fees.

1. Who we are

This website, uaresidency.com, is operated by a licensed Ukrainian attorney in private practice. The following information is published in accordance with Article 7 of the Law of Ukraine "On Electronic Commerce" and Article 12 of the Law of Ukraine "On Advocacy and Advocate's Activity".

In these Terms, "we", "us", "our" and "UA-Residency" mean the attorney and the individual entrepreneur identified above. "You" and "Client" mean the person using this website or engaging our services.

2. Scope of these Terms

These Terms govern your use of this website and, where expressly incorporated, the provision of our services. They do not replace an individual engagement agreement. Where an engagement agreement signed by you and by us contains different provisions, that agreement prevails.

3. What we do and what we do not do

3.1 Services we provide

We provide legal services to foreign nationals in relation to Ukrainian immigration, corporate and citizenship law. Depending on the matter, this may include:

  • assessment of your eligibility under Ukrainian law and written legal advice;
  • preparation, review, translation and notarisation of documents;
  • lawyer's requests to Ukrainian state archives and public authorities;
  • preparation and submission of applications on your behalf under a power of attorney or an order;
  • representation before the State Migration Service of Ukraine, state archives, notaries and other bodies;
  • accompanying you to appointments in Ukraine;
  • company incorporation, corporate address and accounting support;
  • representation in Ukrainian courts where a matter requires litigation.

3.2 Services we do not provide

We do not and cannot:

  • issue, grant, approve or expedite any visa, residence permit, passport, citizenship decision or other official document;
  • influence, or offer to influence, the decision of any official or public authority by improper means;
  • guarantee that any application will be approved, or approved within any particular time;
  • act as a government agency, or as an authorised agent of any government;
  • provide services in relation to any immigration lottery, visa ballot or similar scheme;
  • provide tax, investment or financial advice.

3.3 No guarantee of outcome

All decisions on immigration, residence and citizenship applications are made by the competent Ukrainian authorities at their own discretion and in accordance with Ukrainian law. Any success rates, processing times or timeframes mentioned on this website reflect our past experience and are indicative only. They are not a promise, warranty or guarantee of any particular result in your matter. Law and practice change, and outcomes depend on facts specific to each client, including the completeness and authenticity of the documents provided.

4. Website content is not legal advice

The content of this website is general information about Ukrainian law and is not legal advice. It does not take account of your circumstances and must not be relied upon as a substitute for advice on your specific matter. Nothing on this website creates a lawyer and client relationship between you and us.

5. How an engagement begins

Submitting a form, sending an email, booking a consultation or making a payment does not by itself create a lawyer and client relationship. We are engaged only when:

  • we have carried out our client identification and conflict of interest checks;
  • a written engagement agreement has been concluded between you and us; and
  • the agreed fee, or the agreed first instalment, has been received.

We may decline to accept any matter, and we are not obliged to give reasons.

6. Fees, payment and refunds

6.1 Transparent pricing

Prices published on this website are our professional fees for the service described. Where a price is stated to be all inclusive, the items included and excluded are set out on the relevant page. Prices are indicative until confirmed in your engagement agreement, which is the binding statement of the fee for your matter.

6.2 Official fees

Official state fees, consular fees, court fees, notarial fees and archive fees are set by the Ukrainian authorities or by third parties and are not our income. Where these are not included in our fee, this is stated. Official fees may change without notice.

6.3 Payment

Fees are payable in advance unless the engagement agreement provides otherwise. Payment may be requested through a secure payment link. We do not receive or store your full card details.

6.4 Refunds

Because our fee is for professional work performed, refunds are handled as follows unless your engagement agreement provides otherwise:

  • if you withdraw before we have begun work, the fee is refunded in full, less any third party costs already incurred on your behalf;
  • if you withdraw after work has begun, we refund the balance of the fee corresponding to work not yet performed, less third party costs already incurred;
  • if an application is refused by the authorities despite our work being properly performed, the fee is not refundable, because the fee is for the legal service and not for a guaranteed outcome. Where an eligibility check establishes that you do not qualify, this is stated to you in writing and the remaining stages are not charged;
  • third party costs already paid to archives, notaries, translators, consulates or state bodies are not refundable to the extent they are non recoverable.

7. Your obligations

You agree to provide complete, accurate and truthful information and authentic documents, and to inform us promptly of any change. We are required by law and by professional rules to refuse to act, and to terminate an engagement, where we become aware that a client has provided false documents or seeks to obtain a document or status by unlawful means. In such a case fees paid for work already performed are not refundable.

8. Confidentiality and attorney client privilege

Information you give us in connection with legal assistance is protected by attorney client privilege under Article 22 of the Law of Ukraine "On Advocacy and Advocate's Activity". We may not disclose it without your consent, except where disclosure is required by law. This protection is a professional obligation of the attorney and continues after the engagement ends. 9. Conflicts of interest

We carry out a conflict check before accepting a matter and we will decline or withdraw where a conflict of interest arises under the Rules of Advocates' Ethics.

10. Limitation of liability

We are liable for loss caused by our failure to exercise the professional skill and care reasonably expected of a Ukrainian attorney. To the extent permitted by law, we are not liable for:

  • decisions, delays, refusals or changes of practice by state authorities;
  • consequences of incomplete, inaccurate or late information or documents provided by you;
  • changes in legislation after our advice is given;
  • acts or omissions of third parties such as notaries, translators, couriers, consulates or archives, where we have selected them with reasonable care;
  • indirect or consequential loss, including loss of profit or opportunity.

Our aggregate liability in relation to any matter is limited to the amount of the professional fee paid to us for that matter, save where liability cannot be limited by law.

11. Intellectual property

The text, design, graphics and materials on this website are our property or are used with permission, and may not be reproduced for commercial purposes without our written consent.

12. Complaints and professional supervision

If you are dissatisfied, please contact us first and we will respond within 14 calendar days. As a Ukrainian attorney we are subject to the professional supervision of the Bar. A complaint about the conduct of an attorney may be submitted to the Qualification and Disciplinary Commission of the Bar of the City of Kyiv, or through the Ukrainian National Bar Association at unba.org.ua.

13. Governing law and jurisdiction

These Terms and any engagement are governed by the law of Ukraine. Disputes are subject to the jurisdiction of the courts of Ukraine, unless mandatory consumer protection rules of your country of residence give you a different right.

14. Changes

We may amend these Terms. The version in force is the one published on this page, with the date of last update shown at the top. Amendments do not affect an engagement agreement already concluded.
